WARUN - Terms & Conditions

Version effective from 05.08.2026. Previous version effective from 01.06.2024.

1. Who we are and what this document is

Warun is provided by:

We trade as "Plandeka Software". In these terms, "we", "us" and "our" mean the provider named above, and "you" means you, the user.

"Service" means all of it: the website at warun.nu, the web application at app.warun.nu, and the Warun mobile applications, together with the information shown in them.

These terms form an agreement between you and us about your use of the Service. Please read them before you use it. If you do not agree with them, do not use the Service. How we handle personal data is described separately in our Privacy Policy.

2. Climbing safety — read this part

Climbing is dangerous. It can cause serious injury and death. Warun does not make it safe.

Warun shows weather observations and forecasts obtained from third parties, presented as an indication of what conditions at a climbing area may have been or may become. Specifically:

  • Warun does not tell you whether it is safe to climb. It does not assess the condition or strength of any rock face, route, hold, anchor, bolt, or item of fixed protection, and it cannot.
  • The data is modelled and approximate. Weather models work on a grid measured in kilometres. They cannot know a particular crag's aspect, shade, seepage, drainage from ground above it, wind exposure, local microclimate, or how long that specific rock takes to dry. Two walls a hundred metres apart can be in completely different condition.
  • Rock type. Some rock, sandstone in particular, loses a large part of its strength when wet, and holds and whole features can break under a load they would carry when dry. A reading in Warun that suggests dry conditions is never an assurance that rock is dry, has dried through, or is sound.
  • Warun is not an emergency, rescue, or warning service. Do not rely on it for severe weather warnings, lightning risk, flooding, rockfall, or avalanche information. In an emergency call 112.

You are solely responsible for deciding where and whether to climb. By using the Service you accept that climbing carries inherent risks that you assume yourself, and you agree to assess conditions with your own eyes at the location, inspect the rock and your protection, judge your own ability and equipment, and make your own decision. Warun is not a substitute for training, experience, instruction, a qualified guide, a guidebook, or your own judgement. If what you see on site does not match what Warun showed you, trust what you see on site.

Showing a climbing area in Warun is not permission to climb there, and is not a statement that access is lawful or open. Access rights, land ownership, national and landscape park rules, local agreements, and seasonal closures — including closures to protect nesting birds — are your responsibility to check and respect before you go. These change, and Warun does not track them.

3. The Service is free

Warun is provided free of charge. There is nothing to buy in it, there are no subscriptions, and there are no in-app purchases.

We may introduce paid features in the future. If we do, we will tell you clearly and in advance what is being charged for and how much it costs, and we will not start charging you for anything without your express agreement. Features you use free of charge today will remain available to you free of charge unless we give you reasonable advance notice, in which case you may stop using the Service.

Using the Service requires an internet connection. Any data charges from your mobile or internet provider, including roaming charges when you use the Service outside your home country, are between you and that provider and are your responsibility. If you are not the person who pays that bill, please make sure the bill payer agrees.

4. Your account

You need an account to use the Service.

5. How you may use the Service

Use the Service lawfully and sensibly. You agree not to:

6. Third-party data and services

The conditions information in Warun comes from third parties. We select our sources with care, but we do not produce that data, cannot verify it, and have no control over its accuracy, availability, or continuity. A provider may change, delay, or withdraw its data, which may change or interrupt what Warun can show you.

These providers have their own terms, which apply to the data they supply:

7. Availability, changes and updates

We want the Service to work well, but we do not promise it will be available without interruption or free of faults. It may be unavailable for maintenance, because of a problem at a supplier, or for reasons outside our control. Some functions need an active internet connection and a charged device, and we cannot be responsible for a lack of either.

We may change, add, or remove features to develop and improve the Service. Where a change materially reduces what the Service does for you, we will give you reasonable notice where we can.

We may release updates to the mobile applications, and we will supply the updates needed to keep the Service in conformity with this agreement for as long as required by law. Please install updates when offered: if you choose not to, some features may stop working, and to the extent permitted by the applicable consumer legislation we are not responsible for a lack of conformity arising solely from your decision not to install an update we made available and told you about.

We may stop providing the Service. If we discontinue it altogether we will give you reasonable notice where possible. On termination, your right to use the Service ends and you should delete the application from your devices.

8. Intellectual property

The Service, including its software, design, text, graphics, logos, and the Warun name, belongs to us or to our licensors, and is protected by copyright, trademark, and database rights. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use, on the terms set out here.

You may not copy, modify, distribute, sell, or lease the Service or any part of it, create derivative works from it, or attempt to extract its source code, except to the extent that such acts are permitted by mandatory provisions of applicable law — which includes your rights to make a back-up copy and to decompile for interoperability purposes under Directive 2009/24/EC and the Polish Act on Copyright and Related Rights. Nothing in these terms limits those rights.

9. Our responsibility, and its limits

We are liable to you for damage we cause you, on the terms set by law. Nothing in these terms excludes or limits our liability where it may not lawfully be excluded or limited — in particular for damage caused intentionally, for death or personal injury caused by our negligence, or for our obligations under the consumer legislation implementing Directive (EU) 2019/770 on digital content and services. Your statutory rights as a consumer are unaffected by this document.

Subject to that, and to the fullest extent permitted by law:

The Service is a source of information for experienced users exercising their own judgement. It is not a safety device, and it is not offered as one.

10. Ending this agreement

You may stop using the Service at any time, by deleting your account and removing the application from your devices. We may end this agreement as described in section 4 or section 7. Termination does not affect any rights or liabilities that arose before it.

11. Changes to these terms

We may update these terms, for example to reflect changes to the Service or to the law. We will publish the new version on this page and change the version date at the top. If a change is material we will notify you in the app. If you do not accept the new terms, you may end this agreement by deleting your account before that date. Continuing to use the Service after a change takes effect means you accept the updated terms.

12. Governing law and disputes

This agreement is governed by Polish law. If you are a consumer resident in another country of the European Union, this choice does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country. Otherwise disputes are subject to the jurisdiction of the Polish courts.

If something goes wrong, please contact us first at contact@warun.nu — most problems are easier to solve that way. As a consumer you may also be able to use out-of-court dispute resolution, and you can find information about consumer rights and the available procedures from the Polish Office of Competition and Consumer Protection (UOKiK) at uokik.gov.pl or from your local consumer ombudsman.
